Welcome to Tinker Coffee. These Terms of Service (“Terms”) govern your access to and use of www.tinkercoffee.com (the “Website”) and any purchase you make through it. The Website is operated by Tinker Coffee Co., LLC, an Indiana limited liability company (“Tinker Coffee,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms, our Privacy Policy, and our Refund and Return Policy, each of which is incorporated into these Terms by reference. If you do not agree, please do not use the Website.

1. Scope

1.1. These Terms apply to retail purchases made through the Website.

1.2. Wholesale accounts, catering, and technical services are governed by separate agreements, quotes, or ordering systems and are not covered by these Terms.

1.3. Purchases made at our cafes are subject to the policies posted or provided at the cafe.

2. Eligibility and Accounts

2.1. You must be at least 18 years old to make a purchase through the Website.

2.2. You may create an account to manage orders and subscriptions. You agree to provide accurate information and keep it current. You are responsible for keeping your login credentials confidential and for all activity under your account. Contact orders@tinkercoffee.com if you suspect unauthorized use.

2.3. We may suspend or close any account that violates these Terms.

3. Products

3.1. We sell freshly roasted coffee, tea, brewing equipment, merchandise, gift cards, and related products (“Products”).

3.2. Coffee is an agricultural product. Tasting notes, roast appearance, and availability vary by harvest and roast. Packaging, labels, and product photos may differ from the item you receive, and colors may display differently depending on your screen.

3.3. We make reasonable efforts to describe Products accurately but do not warrant that descriptions, pricing, or availability information are complete or free of errors.

4. Orders, Pricing, and Payment

4.1. Your order is an offer to purchase. We may accept or decline any order at our discretion, including orders we believe to be fraudulent, placed for resale, or in excess of quantity limits. If we cancel an order after payment, we will issue a full refund.

4.2. Prices are in U.S. dollars and may change without notice. Price changes do not affect orders already accepted, except for subscription renewals as described in Section 7.

4.3. If a Product is listed at an incorrect price due to a typographical or system error, we may cancel any order placed at the incorrect price, even after it has been confirmed, and will refund any amount paid.

4.4. Applicable sales tax is calculated and added at checkout.

4.5. Payment is due at the time of order. We accept major credit and debit cards and any other payment methods displayed at checkout. Payments are processed by third-party payment processors. By submitting payment, you authorize the charge and represent that you are permitted to use the payment method provided.

4.6. Because we roast and ship quickly, we may not be able to change or cancel an order once it is placed. Contact orders@tinkercoffee.com as soon as possible and we will do our best to help.

5. Promotions and Discount Codes

5.1. Discount codes and promotions are subject to the terms stated with the offer. Unless otherwise stated, codes are limited to one per order, cannot be combined with other offers, cannot be applied to prior purchases, have no cash value, and may be modified or withdrawn at any time.

5.2. We may cancel orders or revoke codes that are used in violation of the offer terms or that were distributed without our authorization.

6. Shipping and Delivery

6.1. We ship to addresses within the United States, including APO, FPO, and DPO military addresses. We do not ship to international destinations.

6.2. Coffee is roasted and shipped according to our roasting and shipping schedule. Ship dates and delivery estimates are provided for convenience and are not guaranteed.

6.3. Risk of loss and title pass to you when we deliver the Products to the carrier. Lost, damaged, or incorrect shipments are handled as described in our Refund and Return Policy.

6.4. You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to an incorrect or incomplete address that you provided.

6.5. Shipping fees are non-refundable except as provided in our Refund and Return Policy.

7. Subscriptions

7.1. When you purchase a subscription, you authorize us to charge your payment method on a recurring basis at the interval you selected (for example, every two or four weeks) until you cancel. The price, frequency, and contents of your subscription are displayed when you sign up and in your account.

7.2. You can skip, pause, change, or cancel your subscription at any time from your account portal, or by contacting orders@tinkercoffee.com. Changes take effect for the next scheduled order. Orders that have already been processed will ship and will be charged as scheduled.

7.3. If we change the price of a subscription, we will notify you by email before the new price takes effect. Continuing your subscription after the effective date means you accept the new price.

7.4. Subscription orders are covered by our Refund and Return Policy. Once a subscription order has been processed and shipped, it cannot be canceled or refunded, but lost, damaged, or incorrect subscription shipments will be replaced as described in that policy.

7.5. We may modify or discontinue any subscription program. If we discontinue a program, we will not charge you for any orders after the discontinuation date.

8. Gift Cards and Store Credit

8.1. Gift cards do not expire and carry no service or inactivity fees.

8.2. Gift cards and store credit are not redeemable for cash except where required by law, cannot be used to purchase other gift cards, and are non-refundable.

8.3. Gift cards should be treated like cash. We are not responsible for lost, stolen, or unauthorized use of gift cards.

9. Mobile App and Rewards Program

9.1. Our mobile app is provided through a third-party ordering platform. Your use of the app is subject to these Terms and to the platform provider’s own terms and privacy policy, which are presented within the app.

9.2. Rewards points and app-only offers have no cash value, are non-transferable, and may be adjusted, expired, or revoked in cases of error, fraud, or misuse. We may modify or end the rewards program at any time.

9.3. Orders placed through the app for pickup at a cafe are subject to the policies of that cafe.

10. Email and Text Message Communications

10.1. When you place an order, we will send you transactional emails about that order. If you opt in to our email list, we will also send marketing emails. You can unsubscribe at any time using the link in any marketing email.

10.2. By opting in to our text message program, you consent to receive recurring automated marketing and promotional text messages from Tinker Coffee at the mobile number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel and HELP for help. Mobile carriers are not liable for delayed or undelivered messages. Our text message program is managed by a third-party provider on our behalf.

11. Intellectual Property

11.1. The Website and its content, including text, graphics, logos, images, product names, and design, are owned by or licensed to Tinker Coffee and are protected by copyright, trademark, and other intellectual property laws.

11.2. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any Website content without our prior written permission, except as needed to browse and make purchases.

11.3. “Tinker Coffee” and our logos are trademarks of Tinker Coffee Co., LLC. You may not use them without our written permission.

12. Acceptable Use

You agree not to use the Website in any way that violates applicable law, infringes the rights of others, interferes with the operation or security of the Website, involves automated data collection such as scraping or bots, or attempts to gain unauthorized access to any part of the Website or its systems.

13. Reviews and Submissions

If you submit a review, comment, photo, or other content to the Website or to us, you grant Tinker Coffee a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business. You represent that you own or have the right to share the content and that it does not violate any law or the rights of any third party. We may remove any submission at our discretion.

14. Third-Party Services and Links

The Website relies on third-party services for hosting, payment processing, subscription management, shipping, and messaging. The Website may also contain links to third-party websites. We do not control and are not responsible for the content, policies, or practices of any third party, and your use of third-party services is subject to their own terms.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and all Products are provided “as is” and “as available.” Tinker Coffee disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure. Nothing in this section limits the remedies described in our Refund and Return Policy.

16. Limitation of Liability

To the fullest extent permitted by law, Tinker Coffee and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Website, these Terms, or any Product. Our total liability for any claim will not exceed the amount you paid for the Product or order giving rise to the claim. Some states do not allow certain limitations, so some of these limitations may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Tinker Coffee and its members, managers, employees, and agents from any claim, loss, or expense, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Website.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or your use of the Website will be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to the jurisdiction of those courts.

19. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Website after an update means you accept the revised Terms. The version in effect when you place an order applies to that order.

20. General

20.1. These Terms, together with our Privacy Policy and Refund and Return Policy, are the entire agreement between you and Tinker Coffee regarding the Website.

20.2. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

20.3. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

20.4. You may not assign these Terms. We may assign them in connection with a sale, merger, or reorganization of our business.
