This Terms of Service Agreement ("Agreement") is entered into between Tinker Coffee Co. ("Company") and the user ("User" or "You") accessing and using the services provided by www.tinkercoffee.com ("Website"). By accessing or using this Website, You agree to be bound by the terms and conditions set forth in this Agreement. If You do not agree to all of the terms and conditions contained herein, do not use this Website.

1.1. This Website offers an online platform for purchasing freshly roasted coffee beans and related products ("Products").

1.2. By using the Website, You agree to abide by all applicable local, state, national, and international laws and regulations.

2.1. In order to use certain features of the Website, You may be required to create an account and provide accurate information.

2.2. You are responsible for maintaining the confidentiality of Your account and password and for restricting access to Your computer. You agree to accept responsibility for all activities that occur under Your account.

2.3. You must be at least 18 years old to create an account and use this Website.

3.1. All orders are subject to availability and acceptance by the Company.

3.2. Prices for products are subject to change without notice.

3.3. Payment must be made at the time of order placement. The Company accepts major credit and debit cards.

4.1. The Company will roast and ship all coffee and product orders in accordance with the roasting and shipping schedule. 

4.2. Risk of loss and title for Products purchased from the Website pass to You upon delivery of the items to the carrier.

4.3. Shipping and handling fees are non-refundable.

5.1. The Company takes pride in the quality of its Products. If You are not satisfied with Your purchase, please contact us within 14 days of receiving Your order.

5.2. Refunds or replacements are subject to the Company's discretion and will be processed in accordance with our Returns Policy.

6.1. The Website and its original content, features, and functionality are owned by the Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Website.

7.1. The Company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

8.1. In no event shall the Company, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages.

8.2. The Company's total liability to You for any claim arising out of or relating to these terms shall not exceed the amount paid by You for the Products.

9.1. This Agreement shall be governed by and construed in accordance with the laws of the state of Indiana.

10.1. This Agreement constitutes the entire agreement between You and the Company concerning the subject matter hereof.

10.2. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions.
